1. About LinkTenda

LinkTenda operates as a marketplace and facilitation platform that connects customers, merchants, and delivery partners in the Philippines. LinkTenda is a technology platform — not a seller, restaurant, or delivery company. All transactions for products and services are entered into directly between customers and merchants. LinkTenda is not a party to those transactions.

Merchants on LinkTenda are independent businesses responsible for their own products, pricing, quality and safety, and compliance with applicable laws and regulations. Delivery partners are independent service providers, not employees of LinkTenda.

2. Placing Orders

• You must provide accurate name, phone number, and delivery address when ordering.
• By placing an order, you enter into a direct transaction with the merchant — not with LinkTenda.
• Orders are confirmed once the merchant accepts them.
• For Cash on Delivery (COD), payment is due upon receipt of your order.
• GCash payment is coming soon. Cash on Delivery is currently the only accepted payment method at checkout.
• Cancellations after a merchant has accepted your order may not be possible. Contact us via Messenger immediately if you need to cancel.

3. Platform and Service Fees

LinkTenda may charge fees for use of the platform. These may include:

• Delivery fees — charged to customers per order to compensate delivery partners.
• Platform fees — fees charged to merchants or customers for access to platform features and services.
• Commission fees — a percentage of order value that LinkTenda may collect from merchants for facilitating the transaction.

Any applicable fees are disclosed at the time of the transaction. Platform fees do not make LinkTenda a seller of, or party to, any transaction between a customer and a merchant.

4. Delivery

• Delivery is performed by independent delivery partners, not LinkTenda employees.
• Delivery times are estimates and may vary due to traffic, weather, or order volume.
• You are responsible for being reachable at the contact number provided.
• If no one is available to receive the order, the delivery partner may return it to the merchant.
• Delivery fees are non-refundable once a delivery partner has been dispatched.

5. Merchant Responsibilities

Merchants are solely responsible for the quality, accuracy, safety, and legality of the products and services they offer on LinkTenda. This includes correct menu information, pricing, food preparation standards, and compliance with all applicable local laws and regulations. LinkTenda does not inspect, certify, or guarantee merchant products or services.

6. Refunds and Disputes

If your order arrives incorrect or damaged, contact us via Facebook Messenger within 24 hours. As a marketplace facilitator, LinkTenda will assist in resolving disputes between customers and merchants on a good-faith basis, but is not obligated to issue refunds on behalf of merchants. When GCash payments are available, refunds will be subject to PayMongo's refund processing time.

7. Accounts

• Merchant and delivery partner accounts are by application and approval only.
• You are responsible for keeping your login credentials secure.
• Accounts found to be abusing the platform may be suspended without notice.
• Merchants are responsible for the accuracy of their menus, prices, and availability.

8. Prohibited Use

• Do not place fake or fraudulent orders.
• Do not attempt to disrupt or exploit the platform.
• Do not use the platform for any unlawful purpose.

9. Limitation of Liability

LinkTenda provides a technology platform to facilitate connections between customers, merchants, and delivery partners. As a marketplace facilitator, LinkTenda is not liable for:

• The quality, safety, or accuracy of products or services provided by merchants.
• Actions or omissions of independent delivery partners.
• Losses arising from order delays, cancellations, or errors made by merchants.
• Interruptions to service caused by third-party providers or events beyond our control.

Where LinkTenda's liability cannot be fully excluded under Philippine law, our liability is limited to the value of the platform fees paid for the affected transaction.

10. Changes to These Terms

We may update these terms from time to time. Continued use of LinkTenda after changes are posted means you accept the updated terms.

11. Governing Law

These terms are governed by the laws of the Republic of the Philippines.
